Mbale: Court Issues injunction on Cathedral Avenue contested plot.

Mbale High Court has issued an injunction on the much-contested plot at Cathedral Avenue Near KCB bank.



On the 22nd day of June 2022 Justice Godfrey Namundi made a ruling banning all the contestants on the land and only allowing the contractor Dot Services to work on the Drainage for six months or beyond.







The Judge read the ruling in the presence of Counsel Saali Babu the Lawyer to the defendant Ali Hassan Boto and Ali Boto Estates together with Cassimu Namugali and Counsel Masaba Hamidu the Lawyer to the Plaintiff Nandala Karim.


The court order comes shortly after, serious conflict erupted between Mbale City Council Authority and the camp of Nandala Karim who reinstated the container after the council had demolished the structures and pulled the containers away to pave the way for works to commerce of making the drainage.


This stagnated the Works of the contractor who couldn't continue with his obligation not until 22nd June when the court pronounced that all works shall continue on the land and banned all parties from doing anything on the land for six months or even more.


The Judge noted that all the cases shall be consolidated and heard once after the works have been completed.

1) Civil suit No. 29 of 2023; Nandala Karim Vs Commissioner of Lands,  Ali Hassan and Cassimu Namugali.


2) Civil Suit No. 14 of 2023; Nandala Karim and Another Vs Mbale City


3) Civil Suit No. 17 of 2023; Ali Hassan Vs Karim Nandala and Commissioner of Lands


It should be remembered that the Commissioner of Lands ruled and Cancelled the title of Mr. Nandala Karim and retained the Legality of the title owned by Ali Hassan Boto on the land after the court referred the matter to Land offices to resolve the dispute of ownership of the land.


The RCC and the RPC have been asked to implement the court order that blocks any party except the contractor from acting on the land.
