Mbale Court has dismissed the cybercrime and attempted harm case filed by the embattled former City Education Boss, Linus Nasimiyu, against IUIU lecturer Wakhweya, citing a lack of evidence.
Grade One Magistrate Ezra Morris Oburu, on Thursday afternoon, dismissed all charges and ordered each party to bear their own costs. In his ruling, the magistrate noted that the prosecution failed to prove that Wakhweya had abused the complainant and did not present concrete evidence of the alleged obscene words.
The case stemmed from a 2023 incident where Wakhweya was invited to a meeting involving clan leaders, local council officials, and opinion leaders. The meeting was called after Clementina Kurima was allegedly evicted from her matrimonial home by some of her children due to disputes over property inheritance.
Wakhweya was later accused of collaborating with their brother, Khisa Faustine, to seize family property in Magale Town Council, Namisindwa District. Additionally, he was accused of attempting to take Linus’s job in Mbale City and posting the family’s private matters on social media.
Speaking after the ruling, Wakhweya said he is consulting on whether to sue Linus Nasimiyu for damages and legal costs or to forgive her.
